SHORT RECITAL OF THE CASE

The Jaffer Brothers Limited Employees Union, being the Collective Bargaining Agent, on expiry of the Collective Bargaining Settlement on 31st December, 2013 issued a notice under Section …….. of the Sindh Industrial Relations Act, 2013 along with memorandum of demands on 7th January, 2014. A number of meetings were held between the representative of the Union and the Management with the co-operation of both the parties and the period of notice u/s 42(1) of the Sindh Industrial Relations Act, 2013 was extended from time to time up 15th January, 2015. Finally, both the parties have agreed on the following.

TERMS OF AGREEMENT

1.

In full and final settlement of the Charter of Demands 42(1) of the Sindh Industrial Relations Act, 2013 submitted on 7th January 2014, it is mutually agreed that the Management will pay to all workers a consolidated sum of Rs. 240 per month (Rupees Two hundred forty only per month) in their salaries with effect from 1st January, 2014 in settlement of their Charter of Demands. This amount of Rs. 240 per month will be added to the existing Salaries and Wages already defined in the Payroll of Salaries of the workmen.

Union withdraws the demand of motorbike loans, increase in Eidi and Washing allowance consequently there will be no increase in the Eidi and washing allowance and the exiting amount will continue, instead the management has decided to give an increase of Rs. ….. per month in Conveyance Allowance.

Both the parties have agreed that bonus will be paid according to law.

Conveyance and Meal paid to unionized staff for performing continuous overtime of 5 hours in any day will be increased from Rs. 75/- per day to Rs. 140/- per day (Rs. 90/- for meal and Rs. 50/- for conveyance on actual basis).

The management has agreed to increase the emergency loan fund amount from Rs. 95,000/- per month to Rs. 120,000/- per month. The Employees loan entitlement will increase from Rs. 15,000/- to Rs. 20,000/-. Repayment of the loan would continue to be made in 12 equal monthly installments. (The monthly installment amount will increase accordingly).

The management will discuss with Corporate Finance to improve the audit timings of the PF account enabling HR to provide the PF statement to employees timely.

7.

The management has agreed that the employees who are performing special duty on the request of management during late hours in Ramadan should be provided Rs. 100/- for Iftari. Those who are performing normal second shift duty will not be entitled for Iftari amount.

8.

The management has asked the General Secretary to evaluate about the frequency of exists to labor welfare offices, the management will give him permission on need basis and facilitate him towards workers welfare scheme of Government.

9.

It has been agreed that the existing health insurance scheme will continue and management will follow it for improvement from time to time on need basis.

10.

It has been agreed that payment of overtime will be in time.

11.

The management is already giving welfare support to needy and deserving employees at their own discretion as such there is no need of setting up some welfare scheme as proposed anyhow on the request of union the management has agreed to look into the possibility for setting up a welfare fund for the deserving employees but no timeline has been decided.

12.

It has been agreed by both parties that in addition to this settlement other facilities, amenities, privileges, etc. which are in terms of settlements, usages, custom and practice shall not be altered and will remain the same and will not be discontinued.

13.

The Union undertakes that during the operative period of this settlement it shall not raise any financial demands or demands having any financial implications directly or indirectly on the Management. All demands contained in the Charter of Demands dated 7th January, 2014 shall be treated as settled, disposed off, or withdrawn.

14.

This settlement shall come into force with effect form 01 January, 2014 and shall remain in force up to 30th June, 2016. It is also mutually agreed that the revised and increased benefits as per this agreement and the relevant arrears shall only be paid to those regular workmen who are appearing on company rolls as on 31st December, 2013 and thereafter.

15.

During operative period of this settlement any increase announced by Government through gazette notification will be given without any adjustment.
