AGREEMENT BETWEEN

PAKISTAN NATIONAL SHIPPING CORPORATION (PNSC)

AND

PNSC WORKMEN UNION (C.B.A)

1. As a result of number of meetings held between the PNSC Management and the C.B.A to discuss and finalize the Charter of Demands submitted by the C.B.A vide letter No. WMU/059/012, dated 07-08-2014, consensus was reached and is covered in detailed in succeeding paras.

2. The following nominated employees attended the meeting:

3. After a series of discussion which were held and concluded on 07th January, 2015 in cordial atmosphere it was mutually agreed upon as follows: -

i. BASIC PAY AND INCREMENTS

Basic Pay of all the employees in Grades I to VII and Workshop workers (both inclusive) shall be increased by 48% and the rates of increments will be enhanced as per increase in Basic Pay and fixation of pay will be made on point to point basis.

ii. HOUSE RENT ALLOWANCE

The existing monthly House Rent Allowance admissible to each of employees in Grade I to VII and workshop workers (both inclusive) shall be increased by 45%.

iii. CONVEYANCE ALLOWANCE

The existing monthly Conveyance Allowance admissible to each of the employees in Grade I to VII and workshop workers (both inclusive) shall be increased by 45%.

iv. CHILDREN EDUCATION ALLOWANCE

The existing monthly Children Education Allowance admissible to each of the employees Grade I to VII and workshop workers (both inclusive) shall be increased from Rs. 5,500/- to Rs. 8,000/- for child/children studying in School/ Colleges/ Universities on production of required certified.

v. WASHING ALLOWANCE

The existing rate of washing allowance admissible to liveried staff and workshop workers shall be increased from Rs. 700/- to Rs. 1,000/- per month.

vi. TECHNICAL ALLOWANCE

a. The existing monthly Technical Allowance be raised from Rs. 500/- to Rs. 800/- per month to all those workers who are getting Technical Allowance. It should be paid at uniform rate.

b. Service and messenger allowance should be increased from Rs. 500/- to Rs. 700/- per month.

vii. SHIFT ALLOWANCE

The existing rate of Shift Allowance admissible to employees in Grades I to VII and workshop workers (both inclusive) if required to perform duties on shift basis for not less than eight hours shall be increased from Rs. 600/- to Rs. 1,000/- per month.

viii. DIRTY ALLOWANCE

The existing monthly Dirty Allowance admissible to entitled staff/workshop workers shall be increased from Rs. 100/- to Rs. 250/- per month.

ix. UTILITIES ALLOWANCE

The existing monthly Utility Allowance admissible to each of the employees in Grade I to VII and workshop (both inclusive) shall be increased by 25%.

x. MEDICAL ALLOWANCE & FACILITIES

It has been agreed upon that:

a. The number of new reputed hospitals, like Tabba Hospital and Laboratories of Agha Khan Hospital to be included in the panel. The medical facilities for employees throughout Pakistan should be provided and a reputable hospital in every district should be taken on PNSC Panel. The existing clause should be implemented in letter and spirits. (Management agreed and approved to implement).

b. The existing monthly Medical Allowance admissible to each of the employees in Grade I to VII and workshop workers (both inclusive) to be increased from Rs. 8,000/- per month to Rs. 12,000/- per month.

c. If in an emergency employee in service are retired incur expenses outside Pakistan from his own during treatment the said amount should be reimbursed by PNSC on approved rate and extended throughout the outside Pakistan.

d. The existing medical facilities after retirement will be extended up to 70 years of age from 68 years for employees and their spouse only. In case of death of employee, wife would be entitled only with cost of maximum Rs. 0.5 million per annum.

e. Regarding prolong illness and in an emergency case of retired employees, the matter shall be decided by the Management on case to case basis upon recommendation of S.M.O.

f. It has been agreed that C.B.A should recommend hospitals in each district of Lahore, Rawalpindi and Peshawar for said purpose and inform S.M.O (Management agreed and approved to implement within 3 months).

g. In case of Parents Medical Facilities (Hospitalization and treatment) be extended throughout Pakistan.

xi. CANTEEN SUBSIDY

The Canteen subsidy be fixed in Head Office on monthly basis from Rs. 33,000/- to Rs. 43,000/- per month.

xii. RECREATION ALLOWANCE/T.A CONCESSION

It has been agreed that Management to write a letter to the Government seeking the approval for the same or intimate present status.

xiii. LEAVE

It has been agreed that the existing of 50 days leave on full pay admissible per year to the staff in Grade I to VII and workshop workers shall be increased to 52 days per year from 50 days.

xiv. GRATUITY

It is agreed/recommended that the PNSC to pay gratuity to the employees in grade I to VII and workshop workers appointed on or after 16-10-1984 w.e.f. 1st July, 2010 on priority basis.

xv. TRAVELLING ALLOWANCE ON RETIREMENT

It has been agreed that the Travelling Allowance on retirement in respect of Sind and Baluchistan shall be raised from Rs. 35,000/- to Rs. 50,000/- for Punjab from Rs. 50,000/- to Rs. 75,000/- and KPK, Northern Area & Azad Kashmir from Rs. 65,000/- to Rs. 95,000/-.

xvi. HOUSE BUILDING LOAN

a.It is agreed that House Building Loan for Grade I to VII & workshop worker may be reduced from 65 Basic to 25 Basic Pay and the deduction period may also be reduced from 15 years to 5 years.

Subject to maximum ceiling of installment not exceeding 30% of the take home salary.

b.It is demanded that Vehicle Loan for Grade I to VII & workshop worker be enhanced from Rs. 50,000/- to Rs. 100,000/- and the period of deduction be reduced from 5 years to 2 years.

xvii. EMPLOYMENT OF DECEASED /RETIRED SONS/ DAUGHTERS/ WIVES

a.In case of Agreement 2012 it was specifically agreed by the management that in case of employee death/ retirement during the service, his/her sons or daughter would be employed on priority basis. This demand which was agreed in the 2012 Agreement should be implemented w.e.f.

b.While making appointment in any cadre, the sons/daughters of ex-employees of PNSC should also be preferred and in case of non-availability of son/daughter, a dependent should also be preferred the vacancy should be filled from the brother and near relatives of employees. During the course of employment 50% son quota shall be kept in all categories on permanent/contract/daily wage basis.

xviii. ALLOCATION OF SEATS FOR EMPLOYEE’S SON IN MARINE ACADEMY

PNSC may arrange with Pakistan Marine Academy to reserve at least 12 seats for the sons of PNSC Unionized employees and worker’s as have been fixed for seafarers. This demand may be implemented immediately.

xix. BURIAL EXPENSES

The existing ceiling for grant of burial expenses be raised from Rs. 30,000/- to Rs. 50,000/- and expenses of the whole family accompanying the deceased to his native place should be borne by PNSC. PNSC employee accompanies with the family of the deceased should be given return air ticket.

xx. EX-GRATIA PAYMENT/ASSISTANCE TO DECEASED FAMILY

Instead of 10 months basic pay it should be enhanced to 12-months basic pay by PNSC.

xxi. MATTERS RELATING TO DRIVERS

The existing Special Allowance admissible to Drivers shall be raised from Rs. 400/- per month to Rs. 600/- per month.

xxii. HAJJ FACILITIES

It has been agreed to increase the quota of Unionized Staff/workshop workers from 6 to 8 persons.

xxiii. EID FESTIVALS

a. It has been agreed that Eid Advance as per existing practices to continue.

b. It has been agreed that on the occasion of Eid-ul-Azha, Bonus may be given depending on Corporation’s financial position.

xxiv. HOUSING SCHEME

It has been agreed that letter be written to the existing Committee to start working on it and put up its recommendations to the Management.

e. The transfer should be effected after every 3 years providing the employee an opportunity to acquaint himself with working of the various departments PNSC.

f. Special allowance be paid to workers/staff who are deputed at Port Qasim Authority and Gwadar.

g. Permanent impressive/attractive identity Cards shall be issued to the employees, as the present cards are not attractive.

h. First Aid Box shall be provided to the Technical Staff at Head Office and workshop.

i. Joint work counsel be constituted as per IRO 2012.

j. The previous agreement (2012-2014) settlement has expired on 30-06-2014, as such all terms and conditions facilities; benefits & allowances being enjoyed by the workers shall continue.

k. That in case the President/office bearers is called to attend seminars /court cases/ matters relating to labour in Lahore/Islamabad, the air tickets as well as all expenses shall be borne by PNSC.

l. In case the services of workers if dispensed with, the aggrieved worker shall be entitled to take the matter to the NIRC/Labour Courts which would adjudicate/ determined the matter and without any objections whatsoever from the management.

xxxiv. TRAINING IN LABOUR COURSES

It has been agreed that Management shall invite recommendations from the C.B.A on the labour courses being conducted by NILAT, I.L.O and Labour Federation.

xxxv. HUT FACILITY

The benefits of hut facility should be extended for five-years after the retirement of the worker.

4. All the existing facilities/ benefits/ allowances not covered by this settlement shall remain in force as usual. It has also been agreed that the concessions/increases allowed are in lieu of financial benefits allowed by the Federal Government during the fiscal year 2014-15 and that may be allowed by the Federal Government in the next financial year 2015-16.

5. This Memorandum of Agreement shall come into force w.e.f. 1st July, 2014 and remain in force upto 30th June, 2016.
