SHORT RECITAL OF THE CASE

Phoenix Armour Workers Union, Head Office, 25, Al-Amna, 2nd Floor, M.A Jinnah Road, Karachi, in its capacity as Collective Bargaining Agent determined by the National Industrial Relations Commission, Islamabad, vide Registration No. 14/2014, served a Charter of Demands, dated January 9th, 2015, (Annex-‘A’) to the Management of M/s. Phoenix Armour (Pvt.) Ltd. P&O Plaza, I.I Chundrigarh Road, Karachi, under Section 35 of the Industrial Relations Act, 2012.

Management on receipt of the Charter of the Demands dated January 9th, 2015 entered into negotiations with the Union, after a series of meetings, wherein the Union pleaded inflation and rise in the cost of living which factor primarily weighted in acceptance of the demands provided herein below with mutual understanding between the C.B.A Union and the Management, the parties arrived at a full and final settlement on all the Demands contained the said Charter of Demands as detailed hereinafter.

TERMS OF AGREEMENT

1. INCREASE IN SALARY/WAGES

It is agreed that wages of every workman shall be increased by Rs. 1000/- per month w.e.f. January 1st, 2015.

2. OVERTIME

Rs. 3/- per hour shall be added to the overtime rate of all workmen. This shall be effective from June 1st, 2015.

3. ALLOWANCES

The following increases are also agreed:-

a. Matric Allowances:

Matric Allowances Rs. 100/- per month, to all guards who possess Matriculation Certificate.

b. Attendance Allowance to CIT/Response Force:

i) Rs. 500/- per month will be paid if the guard attends his duty without any absentee during the first 10 days of the month.

ii) Additional Rs. 500/- per month will be paid if the guard does not remain absent for more than one day during the next 20 days of the month, otherwise he will not be entitled to this allowance.

c. Off Day Allowance

Washing allowance to be paid as under:

A. To response force only.....Rs. 40/- per month.

B. To CIT personnel only except in Karachi.....Rs. 60/- per month.

4. MATERNITY LEAVE

It is agreed that maternity benefits for period of 12 weeks shall be allowed to female workers. No more than 6 weeks precede before the date of confinement.

5. WORKERS PROFIT PARTICIPATION FUND

It is agreed that 5% of profit shall be paid and disbursed in accordance with the provision of the Companies profit (Workers’ Participation) Act, 1968.

6. RETIREMENT AGE

Retirement age will continue to be sixty years. However, based on the nature and requirement of job, the Company at its sole discretion may offer temporary job for a duration of six months to an employee after completion of retirement formalities and settlement of all dues with the Company.

7. LEAVE WITH PAY ON ACCIDENTAL INJURY/HOSPITALIZATION

a) The Management has agreed to grant leave with pay for the period of hospitalization due to accidental injury sustained during performance of duties. Quantum of special leave with pay shall be maximum of three months.

b) The above benefit shall be extended in other cases of hospitalization but only after adjustment all sick and accumulated annual leaves.

8. INSURANCE

In addition, insurance benefits as in force, (mentioned as under) Rs. 200,000/- shall be paid to dependent heirs of a guard who loses his life in an encounter with dacoits.

a. Accidental Death/Injury, on duty (including group insurance) Rs. 3 Lacs-PAPL workers.

b. Accidental Death/Injury, off duty (including group insurance) Rs. 2.0 Lacs-PAPL workers.

The Insurance Cover taken by the Management will have proper schedule of compensation in case of total permanent disability during the course of performance of duty.

9. UNIFORMS/SHOES

Quality of Uniforms may be improved and C.B.A shall be consulted in this regard.

Details of uniforms/shoes being provided currently are as under:

a. Guard & Drivers:

• 2 sets of Uniforms consisting of a trouser & a shirt per annum.

• One pair of DMS Shoes/Drivers Shoes (to drivers) per annum.

• 2 Vests Cotton per annum.

• 2 pair of Socks per annum.

• Jacket/Jersey to PAPL guarding staff as per requirement.

b. Technician Staff: (EBAS, Control Room)

• Two sets of uniform per annum.

• One pair of Shoes per annum.

c. Office Peons (Permanent)

• 3 sets of Shirts and Trousers every year.

• One pair of Shoe every alternate year.

• 3 Vests Cotton per annum.

• 3 pairs of Socks per annum.

10. FUNERAL EXPENSE

It is agreed as under:

If any guard expires while on duty to accident or otherwise or loses his life in any accident, it will be the responsibility of the company to send the dead body to his native place by fastest means. The concerned manager, in such cases, should get formalities completed and arrange dispatch of the dead body to the native place of the deceased by booking the coffin box through air/ambulance as per the situation.

Since, offices of the company are operating in almost all the big cities/towns of Pakistan, the office nearer the native place of the deceased shall be informed to receive the dead body and arrange its proper delivery to the family/relatives of the deceased. One of the Supervisor/Officer of the nearby station may represent the Company at the time of burial.

It is agreed that a sum of Rs. 12,000/- will be paid to the family of the deceased for meeting funeral and burial expenses.

Provided that the above sum shall be Rs. 24,000/- in case guard is killed by the bullet of the dacoits during the performance of duty.

11. DEATH WHILE ON LEAVE/NOT ON DUTY

In case guard is away on leave from his place of posting and dies, there will be no responsibility of the company to make any sort of arrangement. If the guard expires within jurisdiction of his place of posting and no relative or family member is available to take care of the dead body, company will arrange its dispatch to this native place. The procedure detailed in para 9 above shall be followed in such cases.

12. PROVIDENT FUND

Subject to the provision of Income Tax Ordinance, 2001 the Company shall introduce contributory provident fund scheme for all workmen.

13. TA / DA

Management will consider the revision of TA/DA of the workers.

IN WITNESSETH WHEREOF the parties as aforesaid have signed hereunder at Karachi on June 12th, 2015.
