SHORT RECITAL OF THE CASE

WHEREAS the registered trade union namely International Foundation & Garments (Pakistan) (Pvt.) Ltd. United Workers Union, which has also been certified as Collective Bargaining Agent by the competent authority to deal with the matters and grievances of the workers employed in the factory namely; International Foundation & Garments (Pakistan) (Pvt.) Ltd. Situated on Plot No. L-8, Block 22, Federal B Area, Karachi, served a notice of demand dated 1st January, 2012 (received on 2nd January, 2012) under Section 42, IRA 2010, to the said employer whereafter the management issued letter dated 3rd January, 2012 for bilateral negotiations with the said C.B.A Union which was started on 9th January, 2012 and the same continued upto 12th March 2012, whereby the representatives of management and C.B.A Union discussed the matter from time to time and with bilateral negotiation and consent of parties, the following settlement has been arrived at this day 13th March, 2012:-

NOW THIS SETTLEMENT WITHNESSTH AS FOLLOWS:

Demand No. 1

This demand pertains to increase in salary and allowance. The management has agreed to increase the same to all employees/workmen who are in the employment of the company as per following category viz. (A) and (B).

Category (A):

Rs. 1500/- p.m. to all the workers who were confirmed in service upto 31st December, 2005, and are still in the employment of the company. The said increase would be allowed in the following manner: -

(i) Rs. 860/- increase per month in basic pay.

(ii) Rs. 390/- increase per month in house rent allowance.

(iii) Rs. 250/- increase per month in conveyance allowance.

Category (B):

Rs. 1250/- p.m. to all the workers who were confirmed in service between 1st January, 2006 to 31st December, 2011 and are still in the employment of the company. The said increase would be in the following manner: -

(i) Rs. 690/- increase per month in basic pay.

(ii) Rs. 310/- increase per month in house rent allowance.

(iii) Rs. 250/- increase per month in conveyance allowance.

Demand Nos. 2,3,4,5 & 6

The C.B.A Union has agreed to withdraw/drop the aforesaid mentioned demands.

Demand No. 7

The management has agreed to increase the amount of Eidi on the eve of Eid-ul-Fitre from Rs. 600/- to Rs. 700/- per person (workmen/employees) only one time during the year.

Demand No. 8,9 & 10

The C.B.A Union has agreed to withdraw/drop the aforesaid mentioned demands.

Demand No. 11

The management has been pleased to increase the amount for Annual Picnic from Rs. 90,000/- to Rs. 100,000/- once in a year in respect of employees/workmen employed in the factory.

Demand Nos. 12,13,14,15,16,17 & 18

The C.B.A Union has agreed to withdraw/drop the aforesaid mentioned demands.

Demand No. 19

For aforementioned demand, the management has been pleased to revise and increase with respect to production bonus rates for sewing operators/checkers in Sewing Department and Packers in F/G Department only as per Schedule-I, annexed herewith which is also part of this settlement.

Demand No. 20

The C.B.A Union has agreed to drop the above demand.

General

a) In case the Federal or Provincial Government allows any increase in the wages/salaries and/or allowances during the tenure of this settlement, the same shall be implemented in terms of the relevant law/order and/or notification as the case may be.

b) The Company and C.B.A Union have settled all the demands raised by the C.B.A Union vide their Charter of Demands dated 1st January, 2012 as mentioned hereinabove.

c) The demands of the C.B.A Union which are not specifically agreed to in this settlement shall be deemed to have been withdrawn for which the Union has agreed not to press the same in any manner whatsoever.

d) All other terms and conditions and benefits presently enforced which are not altered, changed and/or modified by this settlement will continue to be binding as per existing and prevalent terms and conditions.

e) The C.B.A Union and through it, all employees/workmen employed and working in the factory hereby undertake that they shall extend full cooperation to the management in maintaining the discipline, punctuality, daily attendance, industrial peace, good order/conduct and also to increase production and to maintain targets at their best and further try to increase the same so far as possible.

f) The C.B.A Union also undertakes that in case the required production/standards and/or the target is not maintained and achieved, the management at its discretion to take appropriate action and to proceed and initiate disciplinary action against whosoever would be involved in such matter which may also result in termination of their services in accordance with the provisions of law.

g) The C.B.A Union has also agreed to ensure punctuality in attendance and also to avoid absentism or late comings by the employees/workmen for which the management may take appropriate action against them.

h) The C.B.A Union has further undertaken not to raise or submit any Demand(s) to the management having financial implications/impact or otherwise during the currency of this settlement.

i) The C.B.A Union has further agreed not to interfere in the acts of administration. However, the office bearers of the Union may discuss with management, such issue(s) concerning the employees/workmen which needs to be addressed.

PERIOD OF SETTLEMENT AND APPLICABILITY

This settlement shall come into force with effect from 1st January, 2012 and shall continue for a period of two years, i.e. up to 31st December, 2013 and will be applicable only to the permanent employees/workmen presently working in International Foundation & Garments (Pakistan) (Pvt.) Ltd. Karachi.

In witness whereof, the parties have signed this settlement on 13th March, 2012.
