Trading Corporation of Pakistan Limited Company having its registered office located at the Finance and Trade Centre, 4th & 5th Floor, Shara-e-Faisal, Karachi, hereinafter called “the Corporation” (which expression, wherever the context so admits, shall include and mean its success and assigns).

The Trading Corporation of Pakistan Limited Employees Union which is a Collective Bargaining Agent as defined in the I.R.A. 2012 and being the only Union in the Establishment and is a Union registered under the applicability law, with its registered office at Karachi, hereinafter called “the Union” (which expression wherever the context so admits, shall include and mean its successor, assigns and all eligible regular workmen at any place of its operation and are members of the Union.

SHORT RECITAL OF THE CASE

Whereas the Union submitted its Charter of Demands date 29-06-2011 includes number of demands/grievances of the workers for consideration by the Corporation.

And whereas pursuant to the submission of these demands etc. a copy of which is enclosed (Annex), the representative of the Corporation and the representatives of the Union on various dates entered into a dialogue with view to amicably settle the said demands through the process of discussion, negotiations and Collective Bargaining.

And whereas the parties above named have after discussion now reached an agreement on the terms following in full and final settlement of all matters, demands and disputes, differences as contained in “Annex” including those brought under reference to the Corporation in-writing or orally upto the time of signing of this Agreement.

NOW THEREFORE, THIS AGREEMENT WITNESSED AS FOLLOWS:

A. The C.B.A in consideration is:

i) Entering into and abiding by the Agreement for the period hereinafter mentioned.

ii) Undertaking to keep industrial peace on one hand and co-operating fully with the Corporation in its efforts to increase efficiency and profitability, on the other hand.

iii) Undertaking not to raise or pursue any demand involving financial commitment on the part of the Corporation except benefits and facilities etc., which may from time to time be specifically granted by the Government of Pakistan through the process of law and made applicable to the Corporation.

iv) Agreeing that during the period of the Agreement, there shall be no strike demonstration or slowing down of work in any manner, what-so-ever.

B. The Corporation in view of the increase in cost of living as well, has agreed to allow the following benefits and modification in the existing terms of employment w.e.f. 1st July, 2011 unless otherwise indicated against any item.

TERMS OF AGREEMENT

1. FIXATION OF PAY

a) Efficiency Bar is removed and rate of increment based on average is allowed in the revised pay scales as under w.e.f. 01-07-2011:-

b) If an employee crosses the maximum of scale as a result of increase in his pay, such increase/increment shall be allowed as personal pay as allowed to the officers of TCP.

2. TECHNICAL PAY/SPECIAL PAY

The Fire Fighting staff posted on Fire Tender is allowed special pay of Rs. 110/- per month.

3. HOUSE MAINTENANCE ALLOWANCE

House Maintenance Allowance is increase from 5% to 5.50% per month.

4. CONVEYANCE ALLOWANCE

a) The rate of conveyance allowance is raised form Rs. 2500/- to Rs. 2650/- per month.

b) The employees possessing Motor Cycle/Scooter shall be paid maintenance allowance at the rate of Rs. 2750/- per month.

c) Car maintenance allowance is increased from Rs. 2800/- to Rs. 2925/- per month.

5. SOCKS AND SHOES ALLOWANCE

The existing Socks and Shoes Allowance is increased from Rs. 1000/- to Rs. 1100/- per annum.

6. SITE/SHIFT ALLOWANCE

Site/shift allowance shall be paid @ Rs. 220/- per month.

7. MEAL ALLOWANCE – OVERTIME

Meal charges are increased from Rs. 100/- to Rs. 120/- per month.

8. UTILITY CHARGES

Utility charges are increased from Rs. 700/- to Rs. 900/- per month.

9. LUNCH SUBSIDY

Lunch subsidy to all the Unionized Employees is increased from Rs. 400/- to Rs. 550/- per month.

10. ENTERTAINMENT ALLOWANCE

Entertainment allowance is increased from Rs. 400/- to Rs. 500/- per month.

11. CHILDREN EDUCATION ALLOWANCE REIMBURSEMENT

a) Children Education Allowance is increased from Rs. 700/- to Rs. 800/- per month per child.

b) The existing expenditure in connection with Hifz-e-Quran for the children on unionized employees is increased from Rs. 500/- to Rs. 600/- per month per child.

c) Sons/Daughters of deceased employees will be allowed Children Education Allowance like other employees.

12. REIMBURSEMENT OF EXPENSES OF OBTAINING HIGHER EDUCATION

Admission, tuition and examination fee shall be reimbursed to the employees on completion of Inter or at least two semesters of ACCA, CIMA, PHD in Economics and MBA in Finance/HR from an Institution recognized by the HEC.

13. HOUSE BUILDING/RENOVATION LOAN

i) House Building Loan shall be granted @ 60 basic pay plus DA or Rs. 600,000/- whichever is higher.

ii) The cost of judicial paper Rs. 500/- for Indemnity Bond shall be reimbursed by the Corporation.

14. WELFARE LOAN

Budget for Welfare Loan is increased to Rs. 3,000,000/-

15. MARRIAGE LOAN

Loan on second marriage to an employee shall be allowed provided his wife and expired or separated.

16. RAIN/FLOOD/EARTHQUAKE (DISASTER) LOAN

Rain/Flood/Earthquake loan amounting to Rs. 50,000/- recoverable in 36 equal installments shall be granted to an employee with following conditions:-

a) The employee is domiciled of affected area.

b) The Government has declared the area as disturbed.

c) A certificate from Union Council is issued regarding the extent of loss of property owned by the employee.

d) Loan shall not be granted in case of outstanding amount of earlier loan.

17. MEDICAL FACILITIES

a) Ceiling of purchase of medicine is increased from Rs. 48000/- to Rs. 52000/-.

b) The monitory limit of Room Entitlement during hospitalization in respect of employees is enhanced to Rs. 1600/- per day.

c) Lab facilities at Agha Khan University Hospital shall be allowed for other than routine tests.

d) During hospitalization of an employee Food Supplements shall be allowed on the advice of the Doctor.

e) Instead of three, two estimates will be required from panel Dentists for Orthodontic Dental Treatment.

f) The cost of Hearing Aid for the employee has been increased from Rs. 5000/- to Rs. 7000/-.

18. DAI CHARGES

Dai Charges are increased from Rs. 4000/- to Rs. 6000/-.

19. DEATH AID

Funeral expenses are increased from Rs. 30,000/- to Rs. 40,000/-.

20. PROMOTION

a) Those Naib Qasids who were allowed move over earlier shall be designated as Qasid.

b) Naib Qasids who have completed five years satisfactory service shall be designated as Qasid in Grade – II.

c) The promotion of those employees who were promoted on acting charges basis due to shortfall in regular service/ACRs shall stand regularized.

21. SUPERANNUATION AWARD

Those employees who retire after completion of 25 years of more shall be allowed one month’s gross salary as retiring benefit.

22. SPECIAL SERVICE AWARD

a) Special Service Award equal to one month’s gross pay shall be allowed to the employee who shall complete 35 years service in TCP from the date of signing of this agreement.

b) Special Service Award equal to one month gross pay shall be paid in case of death of an employee during service.

23. ZIARAT FACILITY

a)The present facility of 20 days Special Leave for Umrah twice in the entire service of an employee shall also be applicable in case of Ziarat. Restriction of twice in service in case of Umrah or Ziarat shall remain the same.

b)Non-Muslim employees shall be allowed 20 days special leave for yatra/pilgrimage.

24. LEAVE

Encashment of leave on retirement shall be allowed @ gross pay without deduction of conveyance/maintenance allowance.

25. SPORTS AND CULTURAL ACTIVITIES

Three members committee consisting of the following shall be constituted to make recommendation for establishing a Sports Complex for Sports activities and construction of an Auditorium/Marriage Lawn at Korangi Godown.

(i) A member to be nominated by the Management

(ii) A member to be nominated by the Officers Association

(iii) A member to be nominated by the C.B.A

26. FORMATION OF WELFARE TRUST

Three members committee consisting two members to be nominated by the Management and a representative of C.B.A shall be constituted to examine the possibility of establishing a Welfare Trust and make recommendations for Management’s consideration.

27. SALE OF DIFFERENT COMMODITIES TO STAFF

Management shall supply the commodities procured locally/imported by TCP from time to time to the employees at a rate and quantity to be decided the Management and C.B.A.

28. TCP EMPLOYEES HOUSING SOCIETY

Three members committee consisting of the following shall be constituted to explore the possibility of establishing TCP Employees Housing Society on the land occupied by TCP by virtue of merger of defunct CEC/RECP: -

(i) A member from Legal Division to be nominated by the Management

(ii) A member from REM Division to be nominated by the Management.

(iii) A member to be nominated by the C.B.A

29. GRATUITY

The demand of C.B.A for counting of temporary service rendered by an employee prior to regularization for the purpose of payment of gratuity shall be decided by the Board of Directors separately.

30. OTHER TERMS OF EMPLOYMENT

i) All the existing terms of service as expressly stated and in practice will continue to be enforced, except to the extent modified and covered by this Agreement. The demands contained in the Annex as referred herein before and not specifically mentioned in the body of this Agreement will deemed to have been waived/settled/withdrawn by the Union.

ii) No existing benefits will be compounded with similar benefits stipulated by law or by practice during the period of the operation of this Agreement.

31. DURATION OF AGREEMENT

It is mutually agreed that this Agreement shall be effective from 1st July, 2011 and shall continue to be effective and binding upon the parties until 30th June, 2012 and shall be deemed to be settled under Industrial Relations Act 2012.

32. APPLICATION OF THE AGREEMENT

It is mutually agreed that this Agreement will be applicable only to those permanent workmen who are on pay roll of the Corporation on or after 01-07-2011 and in some cases to retired employees.
