SHORT RECITAL OF THE CASE

TIP Employees & Workers Union Haripur (CBA) submitted a charter of demands (copy attached) to the TIP Management vide their letter No. E&WO-U/12/90-91 dated 17. 5. 1990 containing fifteen demands. The charter of demands was discussed by the representatives of the CBA and the Management in a number of meetings held during the period and finally a package deal was agreed to as under:-

ITEMS OF AGREEMENT

1.

In recognition of the satisfactory services rendered by the TIP Employees & Workers at all levels, and the tremendous progress achieved by them in the field of production during the period it was decided to pay them” Incentive Allowance “ w.e.f. 1st April 1991 in three phases as under:-

a. BPS, 1 to 8

Phase I w.e.f 1st April 1991 10% of basic pay/wages
Phase II w.e.f 1st April 1992 10% of basic pay/wages
Phase III w.e.f 1st April 1993 10% of basic pay/wages

Subject to the condition that the maximum increase so allowed in each phase does not exceed Rs. 225/- per month in any case.

b. BPS, 9 to 15

Phase I w.e.f 1st April 1991 7.5% of basic pay/wages
Phase II w.e.f 1st April 1992 7.5% of basic pay/wages
Phase III w.e.f 1st April 1993 7.5% of basic pay/wages

Subject to the condition that the maximum increase so allowed in each phase does not exceed Rs. 225/- per month in any case.

c. BPS, 16 and above

Phase I w.e.f 1st April 1991 5% of basic pay
Phase II w.e.f 1st April 1992 5% of basic pay
Phase III w.e.f 1st April 1993 5% of basic pay

Subject to the condition that the maximum increase so allowed in each phase does not exceed Rs. 225/- per month in any case.

In the case of piece rated workers, their standard wages will be considered as basic pay/wages for the purpose.

This will be in addition to any further increase in pay and allowances if allowed by the Government during the period of operation of this agreement.

A regular self financing pension scheme in place of gratuity, CPF and EOBI for Employees and Workers of TIP from BPS, 1 to 16 mutatis mutandis on the pattern of Govt pension scheme as approved by the Board of Directors in their 113th Board Meeting held on 1st April 1991, is being implemented purely on adhoc basis w.e.f 1st January 1990. As already agreed to with the CBA vide PA-PSM/5c dated 27 Dec, 1990 subject to subsequent concurrence by the Ministry of Finance.

It was agreed to pay an award of Rs. 2000/- (Two thousand) each for satisfactory performance of service at the time of retirement, instead of gift/gift allowance as presently being allowed.

It was agreed to constitute a committee comprising of CCM, FM PSM and President of the Union to examine in detail the demands allowing interest free loans for house building and for purchase of Car/Motor cycle, to a certain number of staff every year, on easy terms. The committee would finalize its recommendations including rules, terms/conditions and procedure for sanction of these loans and submit the same to the GM/ MD before 30th June 1991 for consideration and approval.

It was agreed in principle to allow an interest free loan up to Rs. 10000 ( Ten thousand) each, to be recovered in easy instalments of Rs. 500/- (Five hundred) per month or 1/3rd of the basic pay, which ever is less, to the Employees & workers of TIP at the time of their daughter’s marriage. The provision of this loan will be allowed only once in service.

GENERAL

The Union has agreed not be raise any demand of financial nature during the period of operation of the agreement and has assured the Management of its unflinching support and cooperation in maintain industrial peace in the factory with a view to assuring continuous growth and development of the factory to which is actually tied the growth and development of the Employees and workers of TIP.

Above agreement has been arrived at between the parties through mutual negotiations carried out in healthy and peaceful environments in a cordial manner.

Both the parties thank and appreciate the efforts made by Secretary (C) / Chairman and members TIP Board of Directors for making these negotiations a success;.

The agreement will remain in force for a period of two years.
